1. Purpose

These terms of use (the "Terms") govern access to and use of vttfrance.com (the "Site") by any person (the "User"). The Site, published by VTTFrance.com (see the legal notice), is a free directory of mountain-bike events, GPX trails, regional guides and clubs, largely fed by its users (the "Contributors").

Using the Site means accepting the Terms. Submitting content also requires accepting them expressly, by ticking the box provided in the form.

2. Access to the Site

The Site is free and requires no account. The publisher strives to keep it available but may suspend, change or discontinue it, in whole or in part, without notice or compensation (maintenance, security, changes to the service).

Users agree not to disrupt the Site, not to use it for unlawful purposes, and not to extract or reuse its content systematically ("scraping") without written permission.

3. Contributions

3.1 Prior moderation

Submitted events, trails, guides and reviews are reviewed before publication. The publisher may, at its discretion and without obligation, publish a contribution, correct it (spelling, formatting, category, map position), shorten it, refuse it or remove it at any time, in whole or in part. If a contribution is refused or removed, the Contributor is told so by email with the reason, except for obvious spam or an invalid address.

3.2 Contributor's commitments

By submitting a contribution, the Contributor warrants:

  • that the information is accurate and up to date to the best of their knowledge (dates, place, prices, organiser), and that they organise the event or are authorised to publish its details;
  • that they are the author of the texts, photos and trails they send, or have obtained from the rights holders every permission needed to publish them under section 4;
  • that they have the consent of any recognisable person in the photos (image rights);
  • that the contribution contains nothing unlawful, defamatory, abusive or discriminatory, does not infringe anyone's rights, and is not advertising unrelated to mountain biking.

The Contributor alone is responsible for the content they send and the consequences of its publication, and indemnifies the publisher against any third-party claim based on a contribution that breaches these commitments.

3.3 Reviews

Reviews must reflect a genuine experience of the event, trail or place concerned. A moderator reads them before publication to remove spam and unlawful content; the publisher does not check that the author actually took part. Nothing is given in exchange for a review. Reviews are shown newest first.

4. Licence granted on contributions

The Contributor keeps the copyright in their contributions. By submitting a contribution, they grant VTTFrance.com a non-exclusive, royalty-free, worldwide licence, for the full term of copyright protection, to:

  1. reproduce the contribution, in whole or in part, on any digital or printed medium (servers, websites, apps, newsletters, social networks, data feeds, print);
  2. communicate it to the public by any means, in particular on the internet;
  3. adapt it: format it, crop or resize photos, simplify or correct GPX trails, summarise, correct and translate texts, and include it in maps, lists, calendars and overview pages;
  4. use it commercially: publish it on pages carrying advertising or affiliate links, and share it with partners (search engines, event aggregators) to spread it further.

These rights cover the Site and any other present or future site or service published by VTTFrance.com or its successors. VTTFrance.com may transfer this licence to a third party if all or part of its business is sold, and may sub-license it to its service providers and distribution partners within the same limits.

The licence is granted free of charge, the Contributor benefiting in return from free publication of their event or work. It continues for contributions already published, including after the Contributor stops using the Site. The Contributor keeps their moral rights: where their name is shown, it stays attached to the contribution, and adaptations do not distort their work.

On request, the publisher deletes or anonymises the personal data attached to a contribution (see the privacy policy). It may also remove a contribution at the reasoned request of its author. Purely factual information (an event's name, date and place), which copyright does not protect, may be kept in the calendar history.

5. Database and publisher content

VTTFrance.com is the maker of the database formed by all the Site's listings, the result of substantial investment in collecting, checking, moderating and geolocating them since 2001 (French Intellectual Property Code, Art. L341-1 et seq.; EU Directive 96/9/EC). Extracting or reusing a substantial part of this database, or repeatedly and systematically extracting insubstantial parts, is prohibited without written permission.

The Site's structure, design, logo and the texts written by the publisher are protected by copyright. Linking to the Site's pages is free. Occasionally reusing an event's details is allowed provided VTTFrance.com is credited with a link to the page concerned.

6. Reporting content

Anyone may report content they consider unlawful, incorrect or infringing their rights, through the contact page or at info@vttfrance.com, stating:

  • the address (URL) of the page concerned;
  • why the content is a problem;
  • their name and email address;
  • a statement that the report is made in good faith.

Reports are reviewed promptly and the reporter is told the outcome. An organiser who finds their event published by someone else can ask for it to be corrected or removed in the same way.

7. Safety and liability

Published information (dates, routes, difficulty, GPX trails, prices) is indicative and mostly comes from Contributors. It may be inaccurate or out of date, and an event may be changed or cancelled: always check with the organiser before travelling.

Mountain biking is a sport that involves risk. Each User rides at their own risk: they assess their level, equipment (a helmet in particular), the weather and the terrain, and respect traffic rules, private property, protected areas, local regulations (access, hunting seasons…) and other users. Publishing a trail does not grant any right of way.

To the extent permitted by law, the publisher is not liable for damage resulting from the use of published information, from how an event is run or its cancellation, or from the content of third-party sites the Site links to.

8. Advertising and affiliate links

The Site is funded by advertising (Google AdSense) and affiliate links (Booking.com, bike-components, Amazon): a purchase made through these links may earn VTTFrance.com a commission at no extra cost to you. As an Amazon Associate, VTTFrance.com earns from qualifying purchases. Advertising slots are labelled as such.

9. Personal data

How we process your data and use cookies is explained in the privacy policy.

10. Changes to the Terms

The publisher may change the Terms at any time; the date of the latest update is shown at the top of this page. The applicable version is the one online when the Site is used. A contribution remains governed by the version accepted when it was submitted.

11. Governing law and disputes

The Terms are governed by French law. In case of dispute, Users are invited to contact the publisher first to seek an amicable solution. Failing that, the French courts have jurisdiction, subject to the mandatory rules protecting consumers, who may in particular bring proceedings in the courts of their place of residence.
